The JOE & THE JUICE APP (the “App”) is available to download on smart devices. The App is published by JOE & THE JUICE A/S (“JOE & THE JUICE” or “we”), a company registered in Denmark under the company registration number (CVR) 26 58 93 55 and which is located at Østergade 26A, DK-1100 Copenhagen K, Denmark.
By downloading or using the App, you accept that these terms and conditions (“Terms”) and our App Privacy Policy will apply to you. Therefore, you must read these documents carefully before using the App as well as any consent forms which you will accept as part of using the App.
By using the App, you accept that the Terms apply to you. Therefore, you must read these documents very carefully before using the App. If you do not accept the Terms, you should immediately stop use of the App and uninstall the App.
1. About the App
We understand how important your time is and have therefore developed the App to make it easier and more fun for you, the user of the App (the “User”) to shop at our bars and to make your relationship with JOE & THE JUICE more rewarding.
Through the App, you are able to purchase items from our menu, including but not limited to our sandwiches, other food items, coffees, juices, and shakes (the “F&B Items”) and then select which of our store locations (“Bars”) you wish to pick-up the F&B Items you have ordered.
You are also able to purchase JOE Cards through the App for certain F&B Items on our menu. For further information as to how JOE Cards work, please see our separate JOE Cards, Reward Cards and Campaign Cards Terms & Conditions.
The purchase of any products made available for purchase through the App, including JOE Cards and/or F&B Items shall be referred to collectively here as the “Products”.
2. Features of the App
The App includes the following features:
a) Registration of your profile;
b) The ability to purchase JOE Cards (subject to our separate JOE Card, Reward Card and Campaign Card Terms & Conditions) which can be used to purchase certain F&B Items both through the App or in JOE & THE JUICE stores;
c) The ability to receive Reward Cards awarded to you through the App (subject to our separate JOE Card, Reward Card and Campaign Card Terms & Conditions);
d) The ability to order F&B Items (your “Order”) and (where applicable to your country of residence only) select to have your items delivered to your chosen delivery address or the Bar in which you shall pick-up your Order;
3. User account
In order to use the App, you must create a User account by following the registration instructions within the App (“User Account”). Your User Account credentials are entirely personal, and you must ensure that those credentials and equivalent information required to access your User Account are kept confidential at all times and are only used in a secure and confidential manner where they are not made accessible to any third parties. Only one User Account may be created per person, any User Accounts suspected to be duplicates with the same personal details or false or fraudulent details of any kind shall be suspended and treated as fraudulent activity.
Before you are able to make any purchases using the App, you must submit valid credit card, debit card or other payment method information in the App (“Payment Details”). We use third party providers to securely store your Payment Details and process your payments. You understand and agree that when you submit your Payment Details, JOE & THE JUICE or its third-party providers may verify that the Payment Details you registered are valid. When you submit your Payment Details, you represent and warrant that you have all legal rights to use the registered Payment Details. You agree to pay for all purchases made through the App under your User Account. You must keep your credit card, debit card or other payment method updated at all times.
You shall be entirely responsible for any use of the App and any purchases or other activity under your User Account. We are not responsible for any losses or costs you suffer, unless the person using your password or secure login method was able to do so because we did not keep that information secure.
If, at any point, you suspect that your User Account has been accessed by an unauthorised third party or that a third party has become aware of your user account credentials, you must notify JOE & THE JUICE immediately at privacy@joejuice.com.
For security purposes we reserve the right to suspend access to your account at any time, or close it permanently, if we believe that your account has been accessed or is being used by a third party or is subject to other fraudulent activity.
4. Prices and availability
The price for each Product is stated in the App. Such prices include taxes, VAT (as applicable) and any other related costs.
We reserve the right to change or update the prices of our Products at any time. This means that some of the prices for our Products may vary while you are using the App. No changes will affect an existing Order made by you if payment has already been made, unless there is an obvious pricing error. We will notify you as soon as we can of any pricing error. If the Products you have purchased are subject to a pricing error, you will have the choice of either confirming the order at the correct price or cancelling your order of that product without charge and being refunded the money paid for that product.
Once your Order has been submitted, and payment is successful we will issue you with a receipt for your Order. This will be sent to you either via the email address you have registered, or it will be made available through the App.
Please be aware that all Products are subject to availability.
5. Allergens
Our food and beverage items available for purchase through the App or in store may contain allergens or be exposed to certain allergens during the preparation time for that particular item. Allergen information for each food and beverage item is available through the App. Please carefully read the allergen information section for each food and beverage product before purchasing such item to determine if that product is suitable for you. JOE & THE JUICE cannot guarantee that any of its food or beverage products made available for consumption, or any third-party products sold by us or used to make our products are free of allergens.
8. Tips
Before submitting your order, you may have the option to make a discretionary payment of a tip on top of the total purchase price of the Products in your basket. The employees working at the Bar that is preparing your Order shall receive 100% of any gratuity payment.
9. Permissible use
The App is made available for your own, personal use in your role as a private individual. The App must not be used for any commercial purposes whatsoever or for any illegal or unauthorised purposes. Your use and access to the App is conditional upon you using the App in accordance with these Terms. You agree that you shall not:
a) Use the App in any way that breaches any applicable local, national or international law;
b) Share your pin code or password with anyone;
c) Use the App in any unlawful manner or in a manner which promotes or encourages illegal activity, including, but not limited to, copyright infringements of JOE & THE JUICE or a third party’s rights resulting from material you upload on to the App;
d) Use or attempt to use another person’s user account and/or access another person’s personal payment data through the App or use another person’s personal payment cards or information when using the App, without the explicit consent of that other person;
e) Attempt to gain unauthorised access to the App or any networks, servers or computer systems connected to the App or in which data on other users are stored;
f) Copy, modify or create derivate works of the App or related technology;
g) Modify, adapt, translate, decompile, disassemble, decipher or reverse engineer any part of the App or re-format or frame any portion of the pages comprising the App, save to the extent expressly permitted by these Terms or by law;
h) Use the App in a way that is offensive, obscene, inflammatory, promotes violence or promotes discrimination on sex, race, religion, nationality, disability, sexual orientation, age or any other basis, or is likely to harass, upset, embarrass, alarm or annoy any other person; or
i) Use the App in a way that it likely to disrupt our service or the App in any way.
10. Pick-up time estimates and Order delivery
You have the choice to either pick-up your Order at a Bar that you select, or, in certain countries only, have your Order delivered to an address of your choice that you provide to us.
You have the choice to either manually enter the Bar that you would like to pick-up your Order, or, in certain countries only, the address in which you would like to have your order delivered. Alternatively, if you choose to share your geo-location with us through your device settlings, we will show you our store locations near you so that you may select the Bar that suits you best for pick-up, or, in certain markets only, we will suggest an address for delivery based on your geo-location (which you will be free to change or correct). Once you have placed an order, we will provide you with a time-estimate in which your order will be available for either pick-up or delivery, whichever you have selected. While of course we aim to have your order ready for you in accordance with any time estimate we have provided to you, we cannot guarantee that your order will be available for pick-up or delivery at the estimated time. Any delays you experience may be a result of the availability of certain products used to make the F&B Items, the number of customers at the specific Bar, time of order, delivery distance or times and other commercial factors. We are not responsible if your Order is not available at the estimated pick-up or delivery time.
Note, we do not provide a delivery service in all countries in which we operate. If you are located in an area within the United States in which we offer a delivery service and have any questions or issues with your delivery, please contact UberEats on 1-866-987-3744 or via their visit their support website here.
11. Cancellation
Once we receive your Order for F&B Items, we will transmit the details of the Order to the relevant Bar that shall prepare your Order for pick-up or delivery, or if you have ordered a loyalty card, process that Order. Once an Order is placed by you, the Order cannot be cancelled. You cannot withdraw or cancel an Order for Products once you have submitted it. Prior to placing an Order, you should carefully review your selection.
12. Term and termination
These Terms (including any future updates) are binding between you and us for as long as you use the App. You are free to close your account with us at any time. To do so please send us a request at care@joejuice.com.
You are free to discontinue your use of the App at any time. We are also free to close the App and discontinue the functionalities which the App provides at any time.
13. Intellectual Property Rights
The copyright in all material contained on, in, or available through the App including all information, designs, data, text, music, sound files, photographs, graphics and video messages, the selection and arrangement thereof, and all source code, software compilations and other material (“Material”) is owned by or licensed to JOE & THE JUICE or its group companies. All rights are reserved. You are not permitted to copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit, disseminate in any form whatsoever or use the Material without JOE & THE JUICE’S prior, explicit permission.
The trademarks, service marks, and logos (“Trade Marks”) and any related intellectual property rights (including without limitation, all modifications, enhancements, derivative works, and upgrades and thereto) contained on or in the App are owned by JOE & THE JUICE or its group companies or third party partners of JOE & THE JUICE. You are not permitted to use, copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit or disseminate the Trade Marks without the prior, written permission of JOE & THE JUICE or the relevant group company or the relevant third party partner of JOE & THE JUICE.
14. App availability, suspension and termination
We reserve the right to suspend or cease providing any services relating to the App, with or without notice, and shall have no liability or responsibility to you in any manner whatsoever if JOE & THE JUICE chooses to do so.
Notwithstanding anything else contained in these Terms, if you fail to comply with these Terms or for any other reason that we deem appropriate, JOE & THE JUICE may, at its sole discretion take any of the following actions:
a) Suspend or terminate your account and therefore access to the App;
b) Issue a warning to you;
c) Remove any content in which you have uploaded;
d) Take legal action against you including proceedings for reimbursement of costs resulting from your breach; and/or
e) Disclose of information to law enforcement agencies if we are of the opinion that this is necessary.
The actions described above shall not restrict the actions in which we may take against you for breach of these Terms for or any other reason we may reasonably deem appropriate.
15. Warranties, liabilities and indemnification
Although we have taken great care in developing our App and the content therein , we neither make or give any representation or warranty as to the accuracy, completeness, currency, correctness, reliability, integrity, quality, fitness for purpose or originality of the App or its content (including but not limited to product descriptions, loyalty journey, JOE Cards, pricing, promotions, offers, charges, preparation time, availability) and, to the furthest extent permitted by law, all implied warranties, conditions or other terms of any kind are hereby excluded. JOE & THE JUICE accepts no liability for any missing or inaccurate additions or omissions of points on the loyalty journey or issue of Reward Cards or Campaign Cardsor other inaccurate information on the App caused due to technical errors, network delays, service downtime or other issues.
To the furthest extent permitted by law, JOE & THE JUICE accepts no liability for any loss or damage of any kind incurred as a result of you or anyone else using the App and any content contained therein.
JOE & THE JUICE shall not be liable to you under or in connection with these Terms (including your use of the App) whether in contract, tort (including negligence) or otherwise. This does not apply to the following types of loss, which these Terms shall not limit or exclude our liability for:
a) Death or personal injury resulting from our negligence;
b) Fraud or fraudulent misrepresentation; and
c) Any other liability that cannot be excluded or limited by applicable law.
To the furthest extent permitted by applicable law, you agree to indemnify JOE & THE JUICE and its group companies, local JOE & THE JUICE bars and other relevant third parties, in full and on demand from and against any loss, damage, costs or expenses which they suffer or incur directly or indirectly as a result of your use of the App in violation of these Terms or applicable laws.
16. Your own device
You are entirely responsible for obtaining and maintaining your own devices and connection needed to access and use the App.
17. Your data
Any personal data that you provide to us through the App shall be processed in accordance with our Privacy Policy available here.
18. Updates
JOE & THE JUICE reserves the right to update the Terms at any time and at JOE & THE JUICE’s sole discretion. If JOE & THE JUICE makes use of this right, the updated version of Terms will be made available through the App and will be effective immediately.
You are responsible for regularly reviewing these Terms in order to be aware of any changes and continued use of the App following such an update of the Terms will constitute acceptance of the new Terms and Privacy Policy.
19. Severability
Should any provision of these Terms be held to be unenforceable, illegal or invalid, such provision may by good faith negotiations or interpretation be replaced by provisions that to the widest extent possible gives effect to the intent and enforcement of the original provisions. If that is not possible, such term or provision shall to that extent be deemed not to form part of these Terms. All other terms and conditions of these Terms shall remain in full force and effect.
20. Applicable law
To the furthest extent permitted by law, these Terms shall be construed, governed and interpreted under the laws of Denmark. The exclusive venue for any legal action (including non-contractual disputes or claims) shall be vested in the ordinary courts of Denmark.
